User Agreement

1. ASA, with its office in Vaduz / Liechtenstein, is owner of MILITARIA321.COM. MILITARIA321.COM acts as a venue to allow anyone to offer, sell, and buy anything, at anytime, from anywhere, in an auction-style format commonly referred to as an "online auction". MILITARIA321.COM is not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of statement concerning the listings, the ability of sellers to sell items or the ability of buyers to buy items. We can also not ensure that a buyer or seller will actually complete a transaction.

2. Our services are available only to individuals who can form legally binding contracts under applicable law. Our services are not available to minors or to temporarily or indefinitely suspended members. If you do not qualify, please do not use our services!

3. As user authentication on the Internet is difficult, MILITARIA321.COM cannot and does not confirm each user´s purported identity. Thus, we have created an user-initiated feedback system to help you evaluate with whom you are dealing.

4. If you are the highest bidder at the end of an auction and your bid is accepted by the seller, you are obligated to complete the transaction with the seller. By bidding on an item you agree to be bound by the conditions of sale included in the item´s description so long as those conditions of sale are not in violation of this Agreement or unlawful. Bids are not retractable except in exceptional circumstances such as a clear typographical error is made, or you cannot authenticate the seller´s identity.

5. MILITARIA321.com can close auctions at any time, if any laws or rules will be violated.

6. Items relating to Nazi Germany, such as German World War II books and memorabilia, are sought after by collectors and historians world wide. These items may be lawfully bought and sold in most countries, including the United States. However, at least four countries have special laws for selling and bidding on such items: Austria, Germany, France and Italy. Since militaria321.com world-wide community includes users from those countries, we should be sensitive to the concerns in these countries, and respect those laws by following some guidelines. If you live in the United States or another country that permits the sale of items related to Nazi Germany, you may list such items without any problems, but you may not display any images with Nazi insignias, like Hakenkreuz, runes, skulls the WSS and similar.

7. MILITARIA321.COM forbids the selling of the following items:
Literatur, DVD´s, MC´s,CD´s, Games, Videos and all other Image/Picture/Audio Media with Nazi Propaganda!
a) All new Media with NAZI Propaganda are forbidden
b) All critical literature like "Mein Kampf" should be listed as a private, non public auction. Please check the "private" option when selling these books. c) Reproductions of Flags with NAZI insignias are forbidden to sell

8. Users from Austria, Germany, France and Italy: Please be sure to know your local government laws. You may not display any images with Nazi insignias, like Hakenkreuz, runes, skulls the WSS and similar. If a seller still displays such insignias, he does this on own risk! If you live in these countries please follow these guidelines.
Nazi related items are:
items with an image of Adolf Hitler or other famous Nazi persons (except stamps and coins)
all items which contain a swastika
all items connected with genocide of the Jewish population, particularly items related to Auschwitz and other concentration camps
books and other print products with racially degrading content or content about Nazi ideology and expansion politics; particularly the book "Mein Kampf"
items connected to Nazi organizations such Jungvolk, Hitlerjugend, SA, SS, Waffen SS, NSKK, Harzburger Front, Stahlhelmbund.

9. MILITARIA321.COM offers a serious marketplace for collectors and historians, however, dissociate itself unmistakably from politically motivated circles.

10. MILITARIA321.COM is very proud about its privacy policy! We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our User Agreement. We will never sell, give or offer these informations to third parties!

11. Who ever bids on self-owned auctions, or bids through middlemen, can be shut out from our website immediatley. Forcing up of prices is strictly forbidden.

12. Joining and bidding on items at MILITARIA321.COM is free. Our Fees Policy is available on our website. We may change our Fees Policy and the fees for our services from time to time.

13. All registered users are committed to pay for auction fees. Its forbidden to allocate fees to the buyer.

14. Fees resulting from using our website are collected from the declared bank account or credit card in the first week of every month.
Questions regarding the invoives and bills are answered within 72 hours at payment@militaria321.com.
All bills are accessible at "My Site" and there they can be displayed and printed out.

Militaria321.com can delete or move auctions for different reasons, special fees resulting from these auctions will still be charged.

15. If an auction is started within a category described as original or if an auction is started with the guarantee symbol, the seller automatically offers a sale or return within 31 days. This right canýt be limited in any way within a description.
Credit notes will not be transferred back to banc accounts or credit cards, but will be credited to your user account and invoice.

16. IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE)
